The Ministry of Communications of the Russian Federation issued a clarification on the decision of the Government №758 July 31, 2014, which establishes the procedure for identification of users on admission to the Internet. Of explanation, it follows that if the access point Wi-Fi network operator installed, the user is required to provide their personal data – name, surname, personal identity document number. If the access point is set to private person, the new rules do not impose on him any duties to obtain personal data.
According to the law on telecommunications operator – is a legal entity or individual entrepreneur, providing communication services on the basis of a license. The ministry noted that the established order of user authentication allows the operator to select how it will pass this procedure. For example, the user can send SMS or fill out a form.
In addition, said the Ministry of Communications, the operator can set the user’s identity through a request to the appropriate authority. At the same time it is noted that the user will be required to provide any identifying information: name, surname, first name, driver’s license number and more.
In the ministry also said that a direct duty to present an identity document, provided with outstanding citizen for service in the community access points, such as the separation of “Mail of Russia” if the connection is provided within the framework of universal services.
The law does not clearly define the term “community access points”, but Article 57 of the law “On communication” refers to the service “universal services”, which also includes “telephone services using payphones” . The law guarantees the provision of universal services in the whole territory of Russia, except for settlements, which are home to at least 500 people.
Earlier, the head of Information Technology Department of the city of Moscow Artem Yermolaev told Itar-Tass that the government decree does not apply to points of free access to the Internet via Wi-Fi in public areas. According to him, in the subway, hospitals, parks and other public places access to the Internet will remain anonymous. “Use Wi-Fi and enjoy the Internet” – wished Muscovites Yermolaev.
Government decision complemented the previously established rules for the provision of telecommunications services. “User authentication is carried out by establishing a network operator surname, first name, middle name (if any) the user confirms the identity document”, – stated in the ruling.
In addition, an organization that provides direct access to the Internet, will have to give your service provider the list of people who use the Internet. Among the data to be transmitted, – surname, name, patronymic, place of residence, the data of the document. Also, the organization will have to record the time and volume of services to provide access to the Internet. All these data communication operator will have to be stored for six months and to provide law enforcement agencies.
On the eve of August 7, the government made it mandatory for social networks and other popular sites to install the hardware and software with which the security services will be able to automatically receive information about the the users’ actions. Corresponding government decree №743 Prime Minister Dmitry Medvedev signed on July 31.
This regulation specifies the provisions of the “law of the bloggers.” It states that sites must connect the hardware and software for the security forces. In this case, the decision prohibits the sites to disclose “organizational and technical methods of operational and search activities.” Who will pay for the installation of this equipment, the regulation does not specify. As stated by RBC “Yandex” and Mail.ru Group, the adoption of this resolution for Internet companies was unexpected.
