On Apple sued for iOS 8 – Mail.Ru

December 31 law firm Audet & amp; Partners, representing the interests of the two owners of the iPhone and iPad from the US state of Florida, filed a lawsuit against the company Apple. Plaintiffs with a 16-gigabyte device, which costs 8 iOS, consider themselves to be deceived – as available to them up to 23% of non-volatile memory on the box with the iPhone and iPad. Apple also accused that she gigabyte is 1000 rather than 1024 megabytes that iOS 8 is required for installation “on air” 5.8 GB of free memory and the result that the OS takes 1.1 GB (almost twice as much than iOS 7). The lawsuit is a collective: if Apple loses the case, the payment will automatically receive all owners of iOS de vices 8, living in the United States. Join the suit they do not need. Also, the company will be obliged to indicate the amount of memory actually available to the user device.

The lawsuit details the suffering of the first plaintiff in the purification of memory 16 GB iPhone 5S (two) and iPad (two) to install iOS 8, as well as the bitterness and confusion experienced by the second plaintiff (will not find on the new iPhone 6 free 16 gigabytes). The lawsuit was filed in California, where the headquarters of Apple. The lawyers of the plaintiffs argue that the company is not pointing to the boxes and on the website available to users iOS-device memory breached just three California law.

Of course, Apple’s lawyers will refer to the global practice (total memory device indicate all manufacturers of smartphones and tablets), but experts of Audet & amp; Partners make a good move. Honest business, they point out, implies that buyers can expect the following – if a certain company sells mobile devices with 8 and 16 GB of non-volatile memory and encourages the transition to the new OS, take up more space, this company guarantees and ensures the normal user experience.

We are very interested what the outcome of the case. If there is a precedent, the worldwide practice may change and manufacturers will be obliged to indicate the amount of memory actually available to the user (along with the total volume). That (we think) is pretty good.
